RISK ACKNOWLEDGEMENT AND RELEASE OF LIABILITY

In consideration of TOPSPORT KAYAKING SPECIALIST LIMITED providing services and/or kayaking equipment to enable me to participate in kayaking and/or running/hiking activities, I agree as follows:

I fully understand and acknowledge that:

  1. Outdoor recreational activities have inherent risks, dangers and hazards (including volcanic activity, landslip, avalanche, rockfall, ice fall, storm, or flooding) and such exist in my use of equipment and/or my participation in kayaking and/or running/hiking activities.
  2. My participation in such activities may result in personal injury.
  3. These risks and dangers may be caused by the negligence of TOPSPORT KAYAKING SPECIALIST LIMITED or the negligence of other participants including myself. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to: guide decision-making, weather or river conditions, water level, falling out of my kayak, falling over in a river crossing or any other dangers that are integral to recreational activities that take place in a wilderness environment.

By my participation in these activities I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole by TOPSPORT KAYAKING SPECIALIST LIMITED or by any other person, including myself. I also verify that I am in good health and that my participation in this activity is voluntary. I also agree to wear appropriate gear during the activities and a properly secured safety approved personal floatation device and helmet at all times during kayaking.

I, on behalf of myself hereby voluntarily agree to release, discharge, hold harmless, defend and indemnify TOPSPORT KAYAKING SPECIALIST LIMITED and its owners and employees from any and all claims, actions or losses for bodily injury, property damage or wrongful death which may arise out of my use of kayaking equipment or my participation in kayaking activities, or my participation in mountain running activities. I specifically understand that I am releasing, discharging and waiving any claims or actions that I may have at the present time or in the future for the negligent acts or other conduct by the owners or employees of TOPSPORT KAYAKING SPECIALIST LIMITED.

Under the Privacy Act 1993 the personal information provided in this form will only be used in an emergency situation and for company office use. I agree to Topsport Kayaking Specialist Limited sending me relevant course, equipment, event and associated material to the email address I have provided.

Topsport Kayaking has a proud history of safety and while every precaution is taken to safeguard you and your belongings, our mountain running and kayaking trips by nature involve a certain amount of risk. Due to this risk, TOPSPORT KAYAKING SPECIALIST LIMITED requires you to sign the following Risk Acknowledgement and Release of Liability Form before departing on your trip. Participants under the age of 18 must have a waiver signed by their parent or legal guardian.

I HAVE READ THE RISK ACKNOWLEDGEMENT AND RELEASE OF LIABILITY FORM AND BY SIGNING IT, AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE TOPSPORT KAYAKING SPECIALIST LIMITED FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
